I've sold a defective CD player.....

I've sold my CD player to a local buyer...he came and tested the player, it worked fine and sounded wonderful to him.
He paid cash on the spot and went home happily....

He called me the next day saying that the player cannot read his disc (it did happened to me a few times before but were OK for the past few weeks b4 I decided to sell)....and he must be frustrated that a new toy would not work the way it should be...

Luckily the player still have warranty coverage and I dug out the receipts and ask him to bring to the shop for warranty claim...

How a nice guy he is and thank me for a few times and saying it's really nice dealing with me and would not hesitate to buy from me again if I have anything that he wanted. :p

If you guys were him...would you piss off?? :p

I personally would not be happy, but it would be in great part because I hate dealing with warrenties and stuff. Good for you it play out smoothly.

Ah! The full disclosure debate. Sounds like someone's seeking affirmation.

Hmmm? Let's see. I've sold musical instuments and amplifiers, lots of paintings, several cars, a few houses, a business and a couple of horses. I'm sure I told the buyers everything I would have wanted to know. Yep. That's exactly how I remember it. I'm sure of it ;-)

And yes, I think you were very successful at getting him to "piss off." As to whether or not he was pissed off, too, well...

Maybe it's just me, but that isn't a story I'd be particulary proud of (selling a known defective player to someone).

In any case, the buyer would only be pissed off if he found out that you knew the player was bad before you sold it to him. Without that knowledge, though, it would "appear" that you are actually helping him out. If you did tell him the player was defective before he bought it then, no, he would have no reason to be pissed off.

Did the buyer ask you about the condition of the CD Player?

If he did, or if you made any statement to the effect that the player functions properly when you knew that the player intermittently failed to operate property (failed to read CDs) and if you failed to disclose or concealed that aspect of its performance when you knew that such knowledge would necessarily have an effect on the purchase decision of a reasonable person, and you concealed or failed to disclose such information in the hope the buyer would purchase your defective CD Player, then I think it might fairly be said you defrauded the buyer.

The fact that you proposed that the buyer test the warranty instead of doing so yourself does not, in my opinion, alter the fact that you defrauded the buyer nor does it justify your conduct.

As to your report that the buyer thanked you and told you how nice it was to do business with you, well, piss on some folks and they think it's raining.

So, for these reasons, to answer your question, if you had done this to me, would I be pissed off?

This story reminds me of the time I had a Radio Shack TRS-80 computer with printer for sale. It worked perfectly, until, while the the buyer was driving 40 miles to my place, at which point, I was setting it up and testing it out before he got there and the disk drive broke.

After I explained what happened, he got pissed for having just driven 40 miles to get it.

This was all beyond my control, but it could have been that he had just gotten it home and then the disk drive went out. The TRS-80 was almost an antique when I tried to sell it, so disk drives for these were proprietary items and weren't being made anymore.

Well, he did ask me the condition of the CDP and he brought his own CD (with scratches all over) to test and he hand picked some CD from my rack to test also....it's all perfect running and he inspected the CDP before he decided.

The unable to read thing happens only 2-3 times for my old CD with some scratches....

The oppo were great on BD but sounded awful if output using analog.

Luckily my Marantz did a good job on the DAC, although the sound not as good as the Cambridge Audio, I still can live with that.
